The Tyler Junior College Board of Trustees meets tomorrow (Thursday 8/25/16) at 11:00 a.m. in the Board Room, White Administrative Services Center, TJC Campus, 1327 S Baxter Ave, Tyler.

Today, our Executive Director, JoAnn Fleming received a prompt response to her inquiry to the TX Attorney General’s Office seeking clarity on whether or not the favorable nationwide injunction received by the TX Attorney General’s Office in their lawsuit against the federal government would also apply to Texas public colleges and universities. JoAnn’s interpretation that the ruling would halt the Obama Administration from forcing its transgender guidelines on all public education institutions – including colleges – until the issue is moved through the federal court system by the Texas Attorney General was correct.
Mrs. Fleming received the following confirmation from First Assistant Attorney General Jeffrey Mateer, explaining that TJC is indeed covered under the nationwide injunction. She later received a phone call from the AG’s Senior Advisor Ben Williams who confirmed the TX Attorney General’s Office would be sending an official letter to TJC officials.
What does this all mean? The TJC Board of Trustees can indeed implement the federal guidelines if the Board so directs campus policy; however, if the TJC Board chooses to do so, it won’t be because the feds are forcing TJC with a threat of withholding funds. The injunction halted that threat until the legal action moves through the upper courts.

In response to your request for clarification regarding the 8/21/16 Preliminary Injunction Order in State of Texas v. U.S., Judge O’Connor’s Order makes clear that Defendants (U.S. Department of Education, U.S. Department of Justice, etc.) are enjoined “from enforcing the Guidelines against Plaintiffs and their respective schools, school boards, and other public, educationally-based institutions.” Accordingly, this nationwide injunction does apply to public colleges and universities as well.
